TERMS OF USE
1. INTRODUCTION
1.1. These Terms of Use Terms govern access to and use of services provided by 2side Music Company.
1.2. By accessing the 2side Music website, registering, or using the services, the user acknowledges that they have read, understood, and agreed to comply with these Terms.
1.3. The Company reserves the right to update these Terms at any time. The updated Terms shall become effective as soon as they are published on the platform.
2. DEFINITIONS
2.1. Company refers to 2side Music.
2.2. Platform refers to the 2side Music website and the services provided through it.
2.3. User refers to artists, record labels, or individuals registered with 2side Music.
2.4. Content refers to music, album covers, metadata, and other materials uploaded by Users to the platform.
2.5. Services refer to the digital music distribution, promotion, and related services provided by 2side Music.
3. SERVICES AND SCOPE
3.1. 2side Music provides a digital music distribution service that allows Users to distribute their music to digital platforms (Spotify, Apple Music, YouTube Music, etc.).
3.2. The Company has the right to offer Users the following services:
- 3.2.1. Distributing music provided by Users to digital platforms,
- 3.2.2. Providing promotion services for distributed Content,
- 3.2.3. Offering revenue reporting and payment services.
3.3. The Company reserves the right to reject or remove any Content due to restrictions or policies imposed by digital music platforms or third-party service providers.
3.4. The User acknowledges that the Services provided by the Platform may be subject to the policies of third-party platforms (Spotify, Apple Music, etc.).
4. USER OBLIGATIONS
4.1. The User warrants that they have the legal rights to any Content uploaded to the platform.
4.2. The User agrees to comply with the following obligations:
- 4.2.1. Not uploading any Content that violates copyright laws or any applicable regulations,
- 4.2.2. Not engaging in fraudulent activities or artificial streaming (fake streams),
- 4.2.3. Not performing any actions that may harm the reputation or services of 2side Music.
4.3. The User acknowledges that any violation of these Terms may result in the suspension or termination of their account.
5. FEES AND PAYMENTS
5.1. The Company reserves the right to charge fees for certain services. The applicable fees will be published on the Platform.
5.2. The User is responsible for providing accurate and valid payment details to receive revenue payments.
5.3. The Company reserves the right to suspend or cancel payments under the following circumstances:
- 5.3.1. If fraudulent or illegal activities are detected,
- 5.3.2. If artificial streaming (fake streams) or any unlawful revenue-generating methods are used,
- 5.3.3. If the User violates these Terms.
6. INTELLECTUAL PROPERTY RIGHTS
6.1. The User warrants that they hold all legal rights to the Content uploaded to the Platform.
6.2. The User grants the Company a non-exclusive, revocable right to distribute and promote their Content on digital platforms.
6.3. The User may not use the Company’s logo, trademarks, or any other intellectual property without explicit permission.
7. ACCOUNT SECURITY
7.1. The User is responsible for maintaining the confidentiality of their account credentials.
7.2. If unauthorized access to the User’s account is detected, they must notify 2side Music immediately.
7.3. The Company reserves the right to take necessary measures to protect accounts from unauthorized access or security breaches.
8. ANTI-FRAUD POLICY
8.1. The User may not generate unfair revenue using illegal or unethical methods (such as bots, artificial streaming, etc.).
8.2. If fraudulent activity is detected, the Company reserves the right to:
- 8.2.1. Suspend or terminate the User’s account,
- 8.2.2. Block or cancel suspicious earnings,
- 8.2.3. Report fraudulent activity to legal authorities if necessary.
9. CHANGES TO THE TERMS
9.1. The Company reserves the right to modify these Terms at any time.
9.2. The updated Terms will take effect once they are published on the Platform.
10. DISPUTE RESOLUTION
10.1. These Terms are governed by the laws of the Republic of Turkey.
10.2. Any disputes between the parties shall first be attempted to be resolved through negotiation.
10.3. If the parties fail to reach an agreement, disputes shall be settled in the Courts and Enforcement Offices of Istanbul.
